By using Execability, subscribing, or interacting with the service, you agree to the following additional terms. These are designed to limit liability, allocate risk, and clarify user responsibilities.

1. Explicit User Responsibility

• You are solely responsible for all actions taken within Execability, including business decisions, task assignments, goal tracking, and any external consequences.
• You assume full risk for relying on Execability for operational, financial, or strategic decisions.
• You are responsible for maintaining security of your login credentials and any devices accessing Execability. Unauthorized access resulting from your negligence is your liability.

2. No Guarantees / “As Is” Service

• Execability is provided “as is” and “as available.”
• We do not warrant uninterrupted, secure, or error-free service. Downtime, bugs, or partial failures are expected as part of software operations.
• Any reliance on data or outputs from Execability is at your own risk. Critical decisions should not be based solely on the platform.

3. Limitation of Liability

• To the maximum extent permitted by law, Profit Pipelines LLC is not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business opportunities, or lost data.
• Where liability cannot be waived by law, our liability is strictly capped at the total subscription fees paid by you in the 12 months preceding the claim.
• This includes errors, omissions, downtime, software incompatibilities, and integration failures with third-party services.

4. Indemnification

• You agree to defend, indemnify, and hold harmless Profit Pipelines LLC, its affiliates, officers, employees, and partners from any claim, loss, damage, or expense arising from:

5. No Warranty on External Integrations

• Execability may integrate with third-party services (e.g., Stripe, Base44 infrastructure, email providers).

• Subscription fees are non-refundable except as required by applicable law.
• Failed payments, billing errors, or disputes are resolved solely at our discretion.
• You remain liable for all charges incurred until cancellation is fully processed.

• You are responsible for all data entered into Execability.
• We do not verify, audit, or correct your data, nor are we responsible for decisions based on inaccurate or incomplete information.

8. Force Majeure

• Profit Pipelines LLC is not responsible for service interruptions, data loss, or inability to perform obligations due to circumstances beyond our reasonable control, including:

  • Cyberattacks
  • Internet outages
  • Third-party service failures

9. Global Compliance & Export
